RERA Registration


REAL ESTATE REGULATORY AUTHORITY (RERA) has become a reality in Kerala. The KRERA Act has come into effect in Kerala from 1st January 2020. All ongoing project must be registered before 31st March 2020. If not, they will be considered new project

We have been a consultant for RERA registration from the inception of the RERA in Kerala and have successfully registered over 25 projects across Kerala.

We have dedicated team that help developers prepare all documents needed for application. Our team will liaise between RERA offices and Developers to ensure that implementation is on timely basis. We will assist developer to answer queries raised by the Department.

We have also tied up with CA firms who will issue CA certificate for withdrawal of funds and regular audit under RERA act.

RERA act has stipulated stringent restrictions for Developers with regards to maintenance of balances in RERA accounts and withdrawal of the same. We will be able to assist Developers in planning and forecasting their working Capital requirement and utilisation to ensure seamless implementation of Projects while ensuring that legal Requirements under RERA are met

RERA has became a reality as on 1St January 2020 and all projects will have to be registered within 3 months. The RERA Act ensure complete financial control over separate projects and has charged Chartered Accountants with responsibility to authorize withdrawals and to perform projects audits. In the Given scenario it is important that an impeccable MIS system should be introduced within the Organization to ensure compliance of the various rules and regulations imposed by RERA.

PROJECT REGISTRATION

REGISTRATION REQUIRED FOR
Projects before starting any of the procedure for sale(advertise, market, book, sell or invite persons in any manner) Ongoing projects for which the completion certificate has not been issued (the promoter to apply for registration within 3 months from the date of commencement)

EXCEPTIONS
The projects with land to be developed: not exceeding 500 sq.m., where the no. of apartments not exceeding 8,which had received completion certificate for the purpose of renovation/repair/redevelopment which does not involve re-allotment, marketing, advertisement, selling etc.

If the development is in different phases, every phase shall be considered as a standalone real estate project & needs registration.

EXTENSION OF REGISTRATION
1. An application to be submitted by the promoter which shall not be less than three months prior to the expiry of the registration granted.
2. On payment of fee equivalent to half the registration fee as prescribed along with an explanatory note setting out the reasons for delay in the completion of the project and the need for extension of registration for the project, along with supporting documents.
3. Extension shall not exceed a period of one year.

REVOCATION OF REGISTRATION

Upon revocation:
1. Debar from accessing the website & specify his name in the list of defaulters display his photograph on website & inform RERA of other States & UT's
2. Shall facilitate remaining development works
3. Shall direct the bank to freeze the account
4. Issue directions to protect the interests of prospective buyers/public

Further Obligation of Authority
1. Authority may consult the appropriate Govt. to carry out remaining development works by the competent authority or by the Association of allottees .
2. No such direction until the expiry of period of appeal
3. In case of revocation, the association shall have first right of refusal for carrying out the works.

DOCUMENTS TO BE SUBMITTED FOR REGISTRATION

1. Duly filled Application Form.
2. Details of enterprise/address, etc.
3. Details of previous projects (last 5 years ) status, delay if any, cases pending, type of land, payment pending etc.
4. Copy of approvals/permit, sanctioned plan + specifications
5. Location/ demarcation of land/ boundaries
6. Proforma of allotment letter, agreement for sale, conveyance deed
7. Number, type and carpet area of apartments, exclusive balcony/verandah/terrace & number & areas of garages for sale
8. Name and address of real estate agents, if any
9. Name and address of contractors, architects, structural engineers & other persons concerned with the development of the project
10. Details regarding exclusive open terrace/exclusive balcony.
11. Detailed estimate of expenditure for construction and the source from which such expenditure is sought to be financed.
12. Detailed technical specifications to be adopted in the project.
13. Copy of front page of Pass Book of the account exclusively opened for this particular project in a scheduled bank.
14. Self attested copy of the following:
15. Building permit including copy of Building permit(s) for previous or subsequent phases if any.
16. Sanctioned plan/Layout approval including copy of approval(s) for previous or subsequent phases if any.
17. Plan of development works to be executed in the proposed project and the plan of proposed facilities to be provided thereof including facilities like fire fighting, drinking water facilities, evacuation services, use of renewable energy, detailed floor plans, site plans and other plans.
18. Land records.
19. Legally valid authorization/agreement issued by the land owners to carry out the proposed real estate project (if applicable)
20. The facilities to be made available to the allottees.
21. Authenticated copy of PAN card.
22. Detailed description of the land.

Declaration with Affidavit in Form B
signed by the Promoter or any person authorized by the promoter
1. He has legal title to the land along with legally valid documents with authentication of title, if the land is owned by another person
2. Land is Free from encumbrances or details, if any…
3. Time period within which he undertakes to complete it
4. 70% of the amount realized from allottees from time to time, shall be deposited in a separate a/c in a scheduled bank to cover the construction cost and land cost – Shall be used ONLY for that purpose; 5. Promoter shall withdraw the amount in proportion to % of completion of work
6. Can withdraw it only after certified by an engineer, architect and a chartered Accountant in practice that withdrawal is in proportion to the percentage of completion
7. Accounts should be audited within 6 months after every financial year by a C A in practice & duly signed and certified statement of accounts shall be produced
8. He shall take all pending approvals on time
9. That he has furnished such other documents prescribed by Rules & Regulations made under this Act
10. Other documents stipulated in Rule 4
* Authenticated copy of PAN card of Promoter
* Audited balance sheet of the Promoter for preceding financial year & IT returns for 3 preceding financial years
* No. of parking areas available in the project 11. Copy of legal title deeds and authentication of titles if land is of another person
12. Details of encumbrances on land
13. If the land is of another person, details such as consent of the owner, copy of Joint Development Agreement, and other documents reflecting title over the land.
14. Other information and documents specified in the respective forms as well as Regulations made by the Authority

Details to be Furnished (in Form A-1)
1. Basic details of the project and promoter like name, address, register number of registered project etc.
2. Other details of the Promoter like PAN, VAT, TIN &Service Tax registration number.
3. Details of the Proposed Development / Project.
4. Estimated cost of the Real Estate Project.
5. Total Expenditure incurred till date for the Real Estate Project.
6. Details of registration fees paid.
7. Permits/approvals/N.O.C.s received.

REGISTRATION FEE

PLOT Rs.10/- per sq. m of plot area

BUILDING
Ongoing Residential - Rs.25/- per sq. m. of total floor area
New Residential - Rs.50/- per sq. m. of total floor area
Commercial or others - Rs.100/- per sq. m. of total floor area

Project with construction and sale of building:
Registration fee = fee for plot + fee for buildings.
In case of withdrawal of application for registration before the expiry of 30 days, 10% Of the fee paid or Rs 50,000 whichever is more, shall be retained by the Authority and remaining Amount shall be refunded within 30 days from the date of withdrawal.

Withdrawal of sums from the separate account

Land cost shall be the cost incurred by the Promoter, whether as outright purchase or lease charges etc.
Construction cost shall be the cost incurred towards on-site expenditure and off-site expenditure for the physical development of the project

Web based online system

Authority shall operate web based online system for applications for registration within a period of one year from the date of its establishment.
